Terms and conditions and information on the use of personal data in connection with the Bayer 04 Reddit competition

1. The organiser of this competition is Bayer 04 Leverkusen Fußball GmbH (hereinafter “Bayer 04”), Bismarckstr. 122–124, 51373 Leverkusen, Germany.

2. Entry to the competition is free of charge and not contingent upon any purchase.

3. Participants must be at least 16 years of age.

4. Only one entry per person is permitted per competition.

5. Employees of Bayer 04, employees of the agencies involved in the campaign, and their respective relatives are excluded from participation.

6. The competition begins on 24 March 2026 and ends on 7 April 2026 at 23:59 (CET).

7. Entry to the competition is via comments under the relevant Reddit post (as described in the post text).

8. The winner will be selected internally by Bayer 04.

9. The winner will be notified via Reddit DM or email.

10. The following prize is available: a special edition Bayer 04 shirt from the 2025/26 season, signed by Nathan Tella.

11. Cash payment of the prize value or exchange of the prize is excluded.

12. The decision is final. Prize claims are non-transferable.

13. Bayer 04 is entitled to exclude from the competition any participants suspected of breaching the terms and conditions of entry or of any other form of manipulation, and, where appropriate, to subsequently revoke and reclaim any prizes.

14. The participant shall indemnify Bayer 04 against all claims by third parties arising from their participation in the competition. Participants who, in the course of their participation in the competition or at the winners’ event, make statements or take actions which, in the opinion of Bayer 04, contravene applicable laws, public decency or the rules of good taste, in particular those constituting statements or actions that glorify violence, are pornographic or politically incorrect, as well as those making statements or taking actions that damage the reputation of Bayer 04, may be excluded from participation in the competition at any time.

15. Bayer 04 reserves the right to terminate or suspend the competition at any time for good cause without prior notice. This applies in particular where there are reasons that jeopardise or prevent the competition from proceeding as planned. Claims for damages by participants are excluded in this case.

16. We reserve the right to make changes to the specific nature of the prizes.

17. Bayer 04 reserves the right to amend or terminate the promotion at any time without prior notice and without giving reasons. Bayer 04 shall make use of this option in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, the promotion cannot be conducted properly.

18. Bayer 04 shall be liable in accordance with the statutory provisions in the event that claims for damages are asserted which are based on wilful misconduct or gross negligence. Insofar as Bayer 04 is not accused of a wilful breach of contract, liability for damages shall be limited to the foreseeable, typically occurring damage. Bayer 04 shall be liable in accordance with the statutory provisions insofar as it culpably breaches a material contractual obligation; however, even in this case, liability for damages shall be limited to the foreseeable, typically occurring damage. Liability for culpable injury to life, limb or health remains unaffected; this also applies to mandatory liability under the Product Liability Act. Any liability for damages beyond that provided for above is excluded, irrespective of the legal nature of the claim asserted. Insofar as liability for damages against Bayer 04 is excluded or limited, this also applies with regard to the personal liability for damages of its employees, staff, representatives and vicarious agents.

19. Bayer 04 accepts no liability whatsoever for the prizes offered as part of the competition, for any defects in them, or for any damage arising from their use or acceptance. Bayer 04 accepts no liability for any interruptions or unavailability of the competition due to technical faults or failures.

20. German law applies. The exclusive place of jurisdiction for all legal disputes arising from or in connection with these terms and conditions or this promotion is Leverkusen.

21. There is no entitlement to the award of a prize. Legal recourse is excluded.

22. Errors excepted.

23. Reddit is in no way connected to this competition and is neither a contact nor a sponsor.

Data Protection

(1) Where personal data of participants is collected as part of the promotion, Bayer 04 will use this data exclusively for the purpose of running the promotion and fulfilling the associated contractual obligations. For example, we use your title, first name, surname and address to send out prizes. The legal basis for the processing is Article 6(1)(b) of the GDPR; where you have given your consent, Article 6(1)(a) of the GDPR also applies.

(2) Upon conclusion of the contract, we collect the following personal data about you as the winner:
• Title
• First name and surname
• Address
• Any differing Instagram profile name at the time of the competition
• Telephone number (if applicable; for clarifying queries)
• Email address (if applicable; for clarifying queries)
• Date of birth (if applicable; for age verification)
• Type of your prize

(3) To fulfil our contractual and legal obligations, we pass on your personal data to internal and external parties. We do not pass on your data to so-called third parties unless there is a legal obligation to do so, you have consented to the transfer, or the transfer is necessary to fulfil a contract between you and us.

(4) Your personal data will be erased, provided that this does not conflict with any statutory retention obligations, if the data is no longer necessary for the purpose for which it was stored, if you have exercised your right to erasure, or if its storage is unlawful for other legal reasons.

(5) Participants/winners are free at any time to withdraw their consent to storage by sending a notice of withdrawal to Instagram@bayer04.de and thereby withdraw from participation. In the event of withdrawal, the participants’/winners’ personal data will be deleted from the database immediately, provided that this does not conflict with statutory retention periods. If the withdrawal occurs before the prize is processed, further participation is thereby excluded.
